Re: Cheney Column on Hearsay

Mr. Cheney's column doesn't start at the beginning. A trial without evidence, due process and witnesses? Girlfriend didn't testify, assume Shea didn't testify, and there is no evidence mentioned.
When first confronted by a cop, the Bill of Rights 5th amendment provides that "No person shall be held to answer for a capital, or other infamous crime unless on presentment or indictment of a Grand Jury... shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property without due process of law."
The 6th amendment also provides the right: "to be confronted with the witnesses against him." There was no witness other than the woman and she did not testify.
Was Shea first indicted by a Grand Jury? What evidence was used to indict? The Grand Jury is the opinion of the people, not government police or Attorney General or States Attorneys.
There was no evidence, only an accusation by an injured (hysterical?) woman and police based on the accusation a hysterical woman. How is the word of either supported without evidence?
The 2008 case railroaded Shea in the lower court and again in the Supreme Court.
When confronted by police you have a constitutional right to say nothing. In fact, what you say may implicate you when there is no personal association to the crime at all.
The evidence Cheney states cannot even confirm Shea was present to commit the crime. Was this conviction supported by a government cop?
The Vermont Constitution only provides for Sheriffs and Constables as our form of police. The important point is under the current police system of the Public Safety Department with state troopers, game wardens, motor vehicle police, UVM police along with village/ town policy, they are hired by the state, city and towns. The Vermont Constitution requires that our only valid police as sheriffs and constables be voted into office. Voting in or out of office makes the Sheriffs and Constables accountable to the people not government.
Police organized and run by the government is a police state.
Police State: A political unit in which the government exercises rigid and repressive controls over the social, economic, and political life esp. by means of a secret police force.
Did Kimberly Cheney support the creation of the police state as an Attorney General?
The State of Vermont is not in compliance with our highest law.This is another example of our government not adhering to the highest laws of this country, the Constitution of the United States.
